These Terms & Conditions govern your use of Athletic Performance Platform (APP/). Please read them carefully. By creating an account, starting a free trial, or subscribing, you agree to them.
APP/ (the "Athletic Performance Platform", "we", "us", "our") is a strength & conditioning training service delivered through our app and website at athleticperformanceplatform.com (the "Service"). The Service is operated by The Athletic Performance Platform Ltd, a company registered in Northern Ireland under company number NI725205, whose registered office is at [registered-office / service address]. You can contact us at conall@athleticperformanceplatform.com.
By using the Service you confirm that you accept these Terms and agree to comply with them. If you do not agree, please do not use the Service. We may amend these Terms from time to time (for example, to reflect changes in the law or our plans). We will post the updated Terms here and update the date below, and where changes materially affect your rights we will take reasonable steps to notify you, for example by email. Continued use after changes take effect means you accept them.
You must be at least 18 years old to purchase a subscription. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian who agrees to these Terms on your behalf. You are responsible for ensuring that taking part in any training programme is appropriate and safe for you (see Section 10).
The Service provides structured strength & conditioning programmes, sport pathways, exercise demonstration videos, session logging and progress tracking, and — depending on your plan — coach check-ins and personalised coaching. Plans currently include:
Plan features and pricing are described at the point of purchase and may change over time. The Service provides general and, at higher tiers, individualised training guidance. It does not provide medical, physiotherapy, or nutritional advice and is not a substitute for professional healthcare (see Section 10).
To use the Service you must create an account with accurate, current information. You are responsible for keeping your login details confidential and for all activity under your account. Your subscription is for your personal use only — you may not share your account or login details with anyone else. Please tell us promptly if you believe your account has been used without your authorisation.
6.1 Paid plans are provided on a rolling monthly subscription basis unless stated otherwise at purchase.
6.2 Current prices are £9.99 (EveryDay Athlete), £50 (Performance Athlete) and £75 (Elite Athlete) per month, in GBP and inclusive of any applicable VAT. The price applicable to you is the one shown when you subscribe.
6.3 Payments are processed by our payment provider, Stripe. By subscribing you authorise us (via Stripe) to charge your payment method the subscription fee and to automatically renew and re-charge your subscription each billing period until you cancel. You are responsible for keeping your payment details valid and up to date.
6.4 If a payment fails, we may retry, suspend, or cancel your access until it is resolved.
6.5 We may change prices. We will give you at least 30 days' notice by email before a change affects you, and the new price applies from your next billing period. If you do not accept it, you may cancel before it takes effect.
We may offer a 7-day free trial of the EveryDay Athlete plan. The trial gives you full access to that plan's features for 7 days at no cost. No payment card is required to start the trial, and the subscription does not begin automatically at the end of the trial unless you choose to subscribe. We may limit trials to one per person and may withdraw or change trial offers at any time.
You can cancel at any time through [your account settings / Stripe customer portal / by emailing us]. Cancellation stops future renewals. Your access continues until the end of the billing period you have already paid for, after which it ends. We do not provide pro-rata refunds for partial periods except as set out in Section 9 or as required by law.
9.1 As a digital service supplied to consumers, you may have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel within 14 days of subscribing and receive a refund.
9.2 If you ask us to begin providing the Service during that 14-day period (for example, by accessing programmes immediately), you accept that we will start straight away and that you may lose the right to cancel once the service has been fully performed, or may be charged for the portion already provided.
9.3 Where you use the free trial before any payment is taken, no charge arises during the trial, and this cancellation right relates to any paid subscription that follows.
9.4 Except where required by law or expressly stated in these Terms, subscription fees are non-refundable.
The Service is for fitness and educational purposes only. It is not medical, physiotherapy, or nutritional advice, and is not a substitute for professional healthcare. Physical exercise carries an inherent risk of injury — you take part at your own risk.
10.1 You should consult a qualified doctor or healthcare professional before starting any exercise programme, particularly if you are pregnant, recovering from injury or surgery, or have a heart condition, high blood pressure, diabetes, a musculoskeletal condition, or any other medical condition, or if you are unsure whether exercise is safe for you.
10.2 You take part in any programme, exercise, or activity voluntarily and at your own risk. You are responsible for exercising within your own limits, using correct technique and appropriate equipment, warming up, and stopping immediately and seeking medical attention if you feel pain, dizziness, or discomfort.
10.3 You confirm that you are in adequate health to exercise and that you will follow the programmes sensibly and safely. Nothing in this section limits liability that cannot be limited by law (see Section 16).
You agree not to:
All content in the Service — programmes, sport pathways, exercise videos, text, graphics, the APP/ name and logo, and the design of the app and website — is owned by us or our licensors. We grant you a limited, personal, non-transferable, non-exclusive licence to access and use that content for your own personal, non-commercial training while your subscription or trial is active. All other rights are reserved, and this licence ends when your access ends.
If you submit content to us (for example, training videos for form review under the Elite plan, or messages to your coach), you keep ownership of it but grant us a licence to use it as reasonably necessary to provide the Service to you. You confirm that any content you submit is yours to share, does not infringe anyone else's rights, and is not unlawful, offensive, or includes another person without their consent.
The Service relies on third parties, including Stripe (payments), our app and hosting providers, and Mailchimp (free-plan downloads and email). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control, though we choose our providers with reasonable care.
We aim to keep the Service available and to improve programmes over time, but we do not guarantee uninterrupted or error-free access. We may update, change, or remove programmes and features, and may carry out maintenance. If we withdraw a plan, we will give reasonable notice and offer a suitable alternative or a fair refund for any pre-paid, undelivered period. For support, contact conall@athleticperformanceplatform.com.
16.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, or for fraud.
16.2 Subject to 16.1, we are not liable for: injury, loss, or damage resulting from your participation in exercise where you have not followed Section 10 or have exercised beyond your safe limits; loss or damage that was not reasonably foreseeable; or business losses (the Service is for personal, non-commercial use).
16.3 Subject to 16.1, our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose.
16.4 We provide the Service to you as a consumer. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 and other applicable law.
We may suspend or end your access if you materially breach these Terms (including Sections 5, 11, or 13) or if required by law. You may stop using the Service and cancel at any time under Section 8. On termination, the licence in Section 12 ends and you must stop using our content.
We are not responsible for failure or delay caused by events outside our reasonable control (for example, outages of third-party platforms, internet failures, or other force-majeure events). We will take reasonable steps to resume the Service as soon as possible.
We process your personal data in line with our Privacy Policy and applicable data-protection law (including the UK GDPR and Data Protection Act 2018). Please read the Privacy Policy to understand how we collect and use your information.
These Terms and any dispute arising out of or in connection with them are governed by the law of Northern Ireland and subject to the non-exclusive jurisdiction of the courts of Northern Ireland. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your home jurisdiction, and mandatory consumer protections there continue to apply.
